Superannuation Splitting
Superannuation Splitting
At Cahill Family Lawyers, we understand the complex legal and financial aspects of superannuation splitting and provide tailored advice based on your unique circumstances, including relevant factors such as the duration of the relationship, financial and non-financial contributions made by each party, and the future needs, which can include age, income-earning capacity and health.
It is important to note that receiving a superannuation split does not convert into cash. This payment remains subject to superannuation legislation, contained within the Family Law Act 1975 (Cth) and regulations contained within the Family Law (Superannuation) Regulations 2025 (Cth), and remains preserved until retirement age. However, this legislation allows for a portion of one party’s superannuation to be transferred to the other, giving both parties a fairer financial outcome after separation.
